These terms and conditions cover the site www.justpushprint.com.

All provisions of this Just Push Print Service Agreement apply to all accounts of Just Push Print, (hereafter referred to as "JPP" in this document). The benefits of, or rights conferred, by this Agreement are non-transferable. Use of JPP accounts is expressly limited to the individual whose name appears on the account. This person is referred to as "User" in the remainder of this Agreement.

Non-Enforcement of this Agreement does not constitute consent and JPP reserves the right to enforce this Agreement at its sole discretion. Use of JPP services constitutes acceptance of this Agreement and this Agreement supersedes all previous representations, understandings or agreements and shall prevail notwithstanding any variance with any other agreement between JPP and User.

JPP reserves the right to change, without notice, JPP services not explicitly covered under this Agreement including, but not limited to, access procedures, menu structures, commands, documentation, JPP hardware, JPP software and services offered.

JPP reserves the right to modify this Agreement upon notifying User. Notification is by posting on the JPP web site and/or by e-mail. Use of JPP services after such notice shall constitute User's acceptance of the modification of this Agreement. In general, JPP will attempt to notify all customers via e-mail prior to any material changes or modifications to this Agreement.

User automatically accepts all of the terms and conditions of this Agreement as stated herein by accessing JPP’s service. If you do not wish to be bound by these terms and conditions, you may not access or use services.

Communications

By signing up for a JPP account, you are agreeing to receive periodic emails including newsletters, updates about JPP products and services, and occasional special offers of interest to JPP customers. You may opt out of these emails at any time without affecting your JPP account.

Services

This Agreement binds the Terms of Service and its conditions thereof to all Services, including personal and business accounts, and Services within those accounts. JPP agrees to provide Services to the User, subject to the Terms and Conditions of this Agreement, in exchange for payment of services and while the User is not in breach of any Terms or Condition of this Agreement.

Billing

User agrees to provide JPP with accurate and complete billing information. If your credit card company refuses payment of amount billed to it, your account will be suspended, and you will need to re-apply. User may update their credit card information by visiting the My Account page. Charges are due when billed by JPP. JPP reserves the right to cancel access to service for User's account(s) for any reason, including but not limited to misuse of JPP products or services, or an indication of credit problems including, but not limited to, rejection of credit card authorization or charges, disputed credit card charges and returned checks.

Content Use Restrictions

The copyright in all material provided on this site is held by JPP. Except as stated herein, none of the material may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, including but not limited to electronic or mechanical photocopying, recording or otherwise without the prior written permission of JPP or the copyright owner. Permission is granted only to display, copy, distribute and download the material on the site for personal non-commercial purposes, expressly provided, however that you do not modify the materials and that you preserve all copyright, trademark and other proprietary notices contained therein. This permission terminates automatically if you breach any of these terms or conditions. Upon termination, you will immediately destroy any downloaded and printed material. You also may not, without JPP’s prior written authorization, mirror any material contained on this site onto any other server. Any unauthorized use of any material contained on this site may violate copyright laws, trademark laws, the laws of privacy and publicity, and communication regulations and statutes and will result in the immediate termination of your authority to access this site.

Trademarks

The trademarks, service marks, logos, and all other intellectual property used and displayed on this site are the intellectual property of JPP, unless otherwise noted. Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any intellectual property, without the prior written permission of the intellectual property owner. JPP aggressively enforces its intellectual property rights to the fullest extent of the law.
The names Just Push Print or justpushprint.com or other JPP trademarks may not be used in any way including in advertising or publicity pertaining to distribution of material on this site, without JPP’s prior written permission. JPP prohibits use of any JPP trademark as a “hot” link to any sites unless establishment of such a link is approved in advance by JPP in writing.

As-is Services, Limitation of Liability, Indemnification

Disclaimer of warranty. The materials on this site are provided “as is” without warranties of any kind either express or implied. To the fullest extent possible pursuant to the applicable law, JPP disclaims all warranties, expressed or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, no-infringement or other violation of rights. JPP does not warrant or make any representations regarding the use, validity accuracy or reliability of or the results of the use of, or otherwise respecting, the material on this site or any site linked to this site.

Under no circumstances, including, but not limited to, negligence, shall JPP be liable for any direct, indirect, special, incidental or consequential damage, including but not limited to loss of data or profits arising out of the use, or the inability to use, the material on this site, even if JPP or a JPP authorized representative has been advised of the possibility of such damages. If your use of material from this site results in the need for servicing repair or correction of equipment or data, you assume all costs and risks thereof.
